To use Beep, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Be at least 18 years old or have legal capacity to enter into contracts
• Represent a legitimate business entity if registering on behalf of an organisation
• Notify us immediately of any unauthorized use of your account

4. Acceptable Use Policy

You agree not to use our services to:

• Send spam, unsolicited messages, or marketing without proper consent
• Transmit malicious code, viruses, or harmful content
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Impersonate any person or entity
• Harass, abuse, or harm others

5. Message Content and Compliance

You are solely responsible for:

• The content of all messages sent through our platform
• Obtaining proper consent from recipients before sending messages
• Compliance with anti-spam laws and regulations (including but not limited to the Unsolicited Electronic Messages Act 2007 in New Zealand and the Spam Act 2003 in Australia)
• Providing opt-out mechanisms as required by law
• Maintaining accurate recipient contact lists

6. Pricing and Payment

Pricing for our services is available on our Pricing page. You agree to:

• Pay all fees associated with your chosen plan
• Provide valid payment information
• Pay for message credits or usage-based fees as incurred
• Accept that prices may change with 30 days notice

7. Message Delivery

While we strive for reliable message delivery, we do not guarantee that all messages will be delivered successfully. Factors beyond our control (such as carrier issues, recipient device status, or network connectivity) may affect delivery. We are not liable for failed or delayed message delivery.

8. Third-Party Integrations

Our service integrates with various third-party business platforms. Your use of these integrations is subject to the terms and conditions of those third parties. We are not responsible for the availability, functionality, or data handling practices of third-party services.

9. Intellectual Property

Beep and its associated logos, features, and functionality are owned by us and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our services without our written permission.

10. Data and Privacy

Our collection and use of your data is governed by our Privacy Policy. By using our services, you consent to our data practices as described in the Privacy Policy.

11. Termination

• Your account shows suspicious or fraudulent activity
• You fail to pay applicable fees

You may cancel your account at any time. Upon termination, your access to the service will cease, and we may delete your data in accordance with our retention policies.

12. Disclaimers and Limitations of Liability

Our services are provided "as is" and "as available" without warranties of any kind. To the fullest extent permitted by law:

• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim

These Terms are governed by the laws of New Zealand. Any disputes shall be resolved through binding arbitration in accordance with New Zealand arbitration rules, except where prohibited by law.

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through our service. Your continued use of Beep after changes become effective constitutes acceptance of the modified Terms.
